1. These terms
These terms are an agreement between you and Federico D'Antonio, doing business as Firstthree, which runs Firstthree. You accept them when you finish setting up your account.
2. Who can use Firstthree
You must be 18 or older. Your account is for you alone. Sign-in links go to your email, so keep that inbox secure.
3. What a grade is, and is not
A grade is an opinion on the craft of a video, produced by an automated system that follows a published rubric. You can read the whole rubric in the learning center.
- It is not a prediction of views, sales, earnings, or virality, and we make no promise about any of them.
- It gives direction, not scripts. It will not write lines for you to say.
- Automated grading can be wrong. Use your own judgment.
- The TikTok Shop policy check points at moments that may break TikTok's published content rules. It is not legal or compliance advice, it can miss things, and only TikTok decides what it restricts or removes.
4. Your videos
- Upload only videos you have the right to use. You keep all rights to your videos.
- You let us process each video only to grade it and show you the result, which includes sending it to the providers named in our privacy policy.
- We delete the file once its grade is saved unless you choose to keep it.
- A share link lets anyone who has it read that report until you stop sharing.
5. The community
- Share only your own videos. A glow-up or a second opinion is always one of your own graded videos.
- Talk craft. No views, sales, earnings, or promises about results, no links, and nothing hateful, harassing, or sexual.
- What you post is shown to other members under your community name: glow-ups to everyone in the community, pod posts to your pod. You can take it down at any time.
- Anyone can report something that breaks these rules. We may hide it, and remove anyone from a pod or the community who keeps breaking them.
6. Fair use
- No illegal content, and nothing that infringes someone else's rights.
- No attempts to get around limits, break the service, or access other people's data.
- No scraping, automated access beyond normal use, or reselling the service.
7. Plans, billing, and refunds
- Paid plans renew automatically every month at the price shown at checkout until you cancel. Cancel online any time from your account page.
- Paid plans are billed monthly in advance, in US dollars.
- You can cancel at any time from your account page. You keep your plan until the end of the month you paid for, then move to the free plan. Nothing you graded is deleted.
- We do not refund partial months or unused grades.
- Switching to a bigger plan charges the difference for the rest of the current month straight away. Switching to a smaller plan also takes effect straight away, and the difference for the rest of the month becomes credit on your next bill rather than a refund.
- If you were charged by mistake, or the service failed because of a problem on our side, write to hello@firstthree.net within fourteen days and we will refund that charge.
- We give at least thirty days' notice by email before a price change affects your next bill.
8. Changes and interruptions
We may change or improve features. To protect the service, grading can pause, for example when usage limits are reached; nothing you have graded is lost when it does.
9. Ending your account
You can delete your account and everything in it at any time from your account page. Deleting it cancels any paid plan you own straight away, and the rest of the month you paid for is not refunded. We may suspend accounts that break these terms and will tell you why.
10. Disclaimers and liability
Firstthree is provided as is, without warranties. To the extent the law allows, our total liability for any claim is limited to what you paid us in the twelve months before it.
11. Governing law
These terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law rules. Any dispute about them or about Firstthree goes to the state or federal courts located in Illinois, unless the law where you live gives you the right to bring it elsewhere.
